Introduction

This Privacy Policy describes the data protection practices of Liv Health LLC ("Liv Health," "we," "our," or "us"). We refer to our websites, applications, and other services together as the "Services." This Privacy Policy is incorporated into our Terms of Use. Capitalized terms used but not defined here have the meanings given to them in the Terms of Use.

This Privacy Policy does not apply to protected health information created or received by the medical practices and providers made available through the Services. That information is governed by HIPAA and described in our Notice of Privacy Practices.

The Information We Collect and the Sources of Such Information

We obtain information about you through the means described below when you use the Services. We need certain types of information in order to provide the Services to you. If you do not provide that information, or ask us to delete it, you may no longer be able to access or use part or all of the Services.

1. Information You Provide to Us

We collect information that you provide directly to us, for example through:

  • Account and product registration and administration of your account
  • Processing your orders and requests for treatment
  • Questions, communications, or feedback you submit to us by form or email
  • Your participation in research, surveys, contests, and sweepstakes
  • Requests for customer support and technical assistance, including online chat
  • Uploads or posts to the Services
  • Employment applications you submit

The specific types of information we collect depend on which Services you use, how you use them, and what you choose to provide. This may include:

  • Name, address, telephone number, date of birth, and email address
  • Information about your medical conditions, treatment options, lifestyle and personal preferences, prescriptions, medical photos, and lab results or other related health information
  • Log-in credentials, if you create an account
  • Billing and financial information, such as shipping address and payment card details, collected by our payment processor, Stripe, on our behalf. We do not store full payment card numbers.
  • Identity verification information, such as a driver's license or other government-issued ID
  • Information about purchases or other transactions with us
  • Information about your customer service interactions with us
  • Demographic information such as age, sex, and similar information required in connection with the Services
  • Information about others, such as when you provide a family member's or friend's contact information or name an emergency contact
  • User-generated content you post publicly or share with other users
  • Your location
  • Any other information you choose to provide in connection with your use of the Services

2. Information We Collect Through Automated Means

We collect information about your use of the Services and the devices you use to access them. We and our service providers may use cookies, SDKs, pixels, and similar tools to collect it.

Our websites. We collect and analyze information such as your IP address, browser type and language, operating system, the state or country from which you accessed the Services, software and hardware attributes including device IDs, referring and exit pages and URLs, platform type, number of clicks, files you download, domain names, landing pages, pages viewed and their order, time spent on particular pages, search terms you use on our sites, date and time of use, time zone, error logs, and similar information.

Location information. We and our service providers may automatically collect general location information — IP address, city, state, or postal code associated with an IP address — from your computer or mobile device. This allows us to provide accurate sales tax information, confirm the state in which you are located for licensure purposes, and deliver content customized to your location. We will ask your permission before collecting precise GPS location information.

Cookies and similar tools. With your consent, we and our service providers use web server logs, cookies, tags, SDKs, tracking pixels, and similar technologies to offer you a more tailored experience. See the Cookie Notice at the end of this policy for detail.

When you first access the Services, you will be prompted to accept, deny, or modify your cookie choices. You may update your preferences at any time by selecting "Your Privacy Choices" at the bottom of the site.

3. Information We Collect from Social Media and Other Platforms

When you like or follow us on Facebook, Instagram, X, TikTok, or other social platforms, we may collect information including your name, email address, and any comments or content you post that relates to us. We also collect your information if you sign up for a promotion or submit information to us through a social platform. If you access the Services through a third-party connection or log-in, you may allow us to access and store certain information from that third party depending on your settings there.

4. Information We Receive from Other Sources

We work with third parties — including providers, pharmacies, laboratories, advertising networks, analytics providers, and marketing partners — who may provide us with additional information about you.

How We Use Your Information

Unless you opt out through our cookie consent tool, we may use your information for our business purposes to:

  • Carry out, improve, and manage the Services and, as applicable, facilitate the provision of healthcare services to you by providers, and ensure those providers have the services and support necessary for healthcare operations.
  • Engage in internal research to understand the effectiveness of the Services and better understand our user base. Where we publish or share this research, it will be presented in de-identified and aggregate form.
  • Communicate with you about the Services, your use of them, or your inquiries, and send communications on behalf of providers, pharmacies, or other healthcare providers using the Services.
  • Communicate with you, in accordance with applicable law, by email, postal mail, or phone about surveys, promotions, special events, or our products and services.
  • Provide technical support and customer service, and troubleshoot technical issues.
  • Verify your identity and administer your account, including processing payments, fulfilling orders, and verifying the authenticity of your government-issued identification.
  • Present content from the Services in the most effective manner for you and your device, allow you to participate in interactive features, and keep the Services safe and secure.
  • Provide you with more relevant advertisements and personalized content, and measure the effectiveness of advertising and content we serve.
  • Help us better understand your interests and needs through analysis and research regarding use of the Services.
  • Comply in good faith with applicable laws and regulations, including to prevent potentially prohibited or illegal activity.
  • Establish, exercise, or defend our legal rights, including protecting against malicious, fraudulent, or illegal activity.
  • For any other purpose disclosed to you at the time we collect your information, or with your consent.

Any health information we collect about you may also be subject to additional protections under your state's laws. We will only use, process, and disclose that information — and will instruct any third party processing it on our behalf to do so — in accordance with the laws of your state of residence.

Combined information. We may combine information collected through the Services with information received from other sources, online and offline, and use and share that combined information in accordance with this Privacy Policy and your consent where required.

Aggregate and de-identified data. We may aggregate or de-identify information so that it can no longer be linked to you or your device. We may use that data for any purpose, including research and marketing, and may share it with third parties.

Online Analytics and Advertising

1. Online analytics

We may use third-party web analytics services, such as Google Analytics, on the Services to collect and analyze usage information through cookies and similar tools; to conduct auditing, research, or reporting; to assist with fraud prevention; and to provide certain features. To prevent Google from using your information for analytics, you may install the Google Analytics Opt-out Browser Add-on.

If you receive email from us, we may use analytics tools such as clear GIFs to capture data about when you open a message or click a link. This allows us to gauge the effectiveness of our communications.

2. Online advertising

The Services may integrate third-party advertising technologies — for example, Meta, Google Ads, and TikTok — that use cookies, pixels, and other technologies to deliver relevant content and advertising for Liv Health products on the Services and on other websites you visit. These ads may be based on the content of the page you are visiting, information you enter such as searches, demographic data, and other information we collect. If you do not wish to receive targeted advertising, update your settings through our cookie consent tool.

We provide customer information, such as hashed email addresses and phone numbers, to service providers and advertising networks, which match it in de-identified form to cookies, mobile advertising identifiers, and other proprietary IDs in order to show you more relevant advertising on other websites and applications. This includes the use of custom audiences and similar audiences on platforms such as Meta, Google, and TikTok. You can opt out at any time as described in Your Choices and Your Rights below.

We do not have access to, and this Privacy Policy does not govern, cookies or other tracking technologies placed on your device by non-affiliated third-party advertising networks. To opt out of Google Analytics for display advertising or customize Google display network ads, visit the Google Ads Settings page. You may also update your advertising preferences directly with Meta and TikTok. We do not control these opt-out mechanisms or their continued availability or accuracy.

If you exercise the opt-outs above, you will still see advertising when you use the Services, but it will not be tailored to you based on your online behavior over time.

3. SMS communications

By providing your phone number and opting in, you consent to receive recurring marketing and non-marketing text messages from Liv Health. Message frequency may vary. These messages may include updates, promotional offers, account notifications, and other information related to your use of the Services. Message and data rates may apply. Text HELP for help. Text STOP to cancel. Carriers are not liable for any delayed or undelivered messages. Consent is not a condition of any purchase — you may still use the Services without agreeing to receive text messages, and you may opt out at any time. We do not share your SMS opt-in or consent data with any third party for marketing or promotional purposes. We may share it with vendors who help us deliver messages, such as platform providers and phone companies.

How We Share and Disclose Your Information

With your consent where required, we may share your information in the following ways:

  • Affiliates and subsidiaries. To deliver products and services to you and ensure a consistent level of service.
  • Healthcare providers and services. With third-party healthcare providers to schedule and fulfill appointments and provide healthcare services, to whom you send messages through the Services, and for other treatment, payment, or healthcare operations purposes, including pharmacy services, at your request.
  • Service providers. With third parties who perform services on our behalf, including billing, payment processing, sales, marketing, advertising, analytics, research, customer service, shipping and fulfillment, data storage, IT and security, fraud prevention, and auditing, consulting, and legal services.
  • Advertising networks, unless you opt out. See Online Advertising above.
  • Protection of Liv Health and others. We may access, retain, and disclose information we hold about you if required by law or in a good-faith belief that doing so is reasonably necessary to comply with legal process, enforce our Terms of Use or this Privacy Policy, respond to claims that content violates third-party rights, respond to your customer service requests, or protect the rights, property, or personal safety of Liv Health, its users, or the public.
  • Business transfers. If we buy, merge with, or partner with other companies, or if some or all of our assets are sold or transferred, user information may be among the transferred assets. Where such a transfer is subject to mandatory restrictions under applicable law, we will comply with them.
  • Public forums and user interactions. Information you post publicly is not confidential, and we may use it for any purpose, including in testimonials or marketing materials. Please take care when using these features.
  • Testimonials and reviews. If you submit a review or testimonial, you consent to our use of your name, likeness, and other information you provide in marketing materials on our website or third-party websites.
  • With your consent, or as you otherwise direct us.
  • Aggregate and de-identified information, at our discretion.

Notice regarding "sale" and "sharing." We do not exchange your personal information for money. However, because we provide hashed identifiers to advertising platforms for custom audiences and cross-context behavioral advertising, that activity is treated as a "sale" or "share" of personal information under California law and as "targeted advertising" under other state privacy laws. Some of the information involved may also constitute sensitive personal information or consumer health data. You have the right to opt out — see Your Rights below and the "Your Privacy Choices" link at the bottom of our site.

We do not share your data internationally at this time.

Your Choices

You may request that we update or delete your personal information by emailing care@livhealth.com. We will use commercially reasonable efforts to correct or delete your information.

Opt out of communications. You may opt out of marketing email by selecting the unsubscribe link at the bottom of any such message, or by emailing your preferences to care@livhealth.com. You may continue to receive service-related and other non-marketing communications.

Disabling cookies. In addition to updating your preferences in our cookie consent tool, you may be able to refuse or disable cookies by adjusting your browser settings. If you refuse, disable, or delete these technologies, some functionality of the Services may no longer be available to you.

Opt out of targeted advertising and the sale or sharing of your information. You may opt out by selecting "Your Privacy Choices" at the bottom of our site, by adjusting your settings in our cookie consent tool, or by emailing care@livhealth.com.

Do Not Track and Global Privacy Control. Some browsers can be configured to send "Do Not Track" signals; we do not currently respond to those. We do honor the Global Privacy Control (GPC) and other recognized opt-out preference signals as an opt-out of the sale and sharing of personal information and of targeted advertising, where required by applicable state law.

Your Rights

Your state's laws may permit you to request that we:

  • Confirm whether we process your personal information;
  • Access, and receive a copy of, certain personal information;
  • Correct information that is out of date or inaccurate;
  • Delete certain information we hold about you;
  • Oppose, cancel, or restrict the way we process and disclose certain information;
  • Transfer your information to another provider (data portability);
  • Opt out of processing for targeted advertising, sales, or profiling that produces legal or similarly significant effects;
  • Limit or require consent for the processing of sensitive personal data; or
  • Revoke your consent to processing.

The exact scope of these rights varies by state. States providing some or all of these rights now or in the future include California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Montana, Nevada, New Jersey, Oregon, Tennessee, Texas, Utah, Virginia, and Washington.

To exercise any of these rights, email care@livhealth.com. Include your name, address (including the state where you reside), and email address so we can respond within the time frame required by your state's law. We may request information necessary to confirm your identity before responding.

Appeals. If we deny your request, you may appeal by emailing care@livhealth.com with the subject line "Data Rights APPEAL," along with the original determination and your reason for appeal. We will comply with the laws of your state of residence in resolving the appeal. You may also file a complaint with your state's attorney general if you believe your request or appeal was not handled in accordance with your state's laws.

California Shine the Light. California residents may request information about the manner in which we share certain categories of personal information with third parties for those third parties' direct marketing purposes.

How We Protect Your Information

We take technical and organizational security measures to protect your information against accidental or unlawful destruction, accidental loss, alteration, and unauthorized disclosure or access. However, no method of transmission over the internet, and no means of electronic or physical storage, is absolutely secure. You acknowledge and accept that we cannot guarantee the security of information transmitted to, through, or on the Services, and that any such transmission is at your own risk.

Where we have given you, or you have chosen, a password that enables you to access the Services, you are responsible for keeping it confidential. We ask you not to share your password with anyone. Information you share in public areas may be viewed by any user of the Services.

Children

We do not knowingly allow individuals under the age of 18 to create accounts that allow access to the Services. If we learn that we have collected personal information directly from a child under the age of 13 through the Services, we will take reasonable steps to delete that information as soon as practicable. If you believe someone under 13 has provided us with personal information, email care@livhealth.com.

Retention of Your Information

We keep your information for no longer than necessary for the purposes for which it is processed. The length of time we retain information depends on why we collected and used it, and on what applicable law requires. In determining the appropriate retention period, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we use it, whether we can achieve those purposes by other means, and applicable legal requirements. Medical records held by the medical practices are retained according to the record-retention requirements of the state in which you received care.

Revisions to This Privacy Policy

We reserve the right to change this Privacy Policy at any time to reflect changes in the law, our data collection and use practices, the features of the Services, or advances in technology. We will make the revised Privacy Policy accessible through the Services, so you should review it periodically. The date this Privacy Policy was last revised appears at the top of the document. If we make a material change, we will provide appropriate notice in accordance with legal requirements. Your continued use of the Services after those amendments will be deemed your acknowledgment of the changes.
